y <br />10.Th€ granting of the required variances would be <br />contrary to the provisions of Municipal Zoning Code <br />Section lO.OBr Subdivision 3 (A) with which the <br />applicant must first comply in order that variances be <br />granted. The Council finds that: <br />. <br />The essential character of the neighborhood will <br />be altered if the proposed variances are granted <br />and the structure in the 0**75' zone is allowed to <br />be expanded. <br />The property in question can indeed be put to <br />reasonable use as an existing single family <br />residence under official controls. The property <br />can be continued in use "as is” as a single family <br />residence. <br />The plight of the applicant is created by the <br />applicant's wish to expand the area of the <br />residence and not by circumstances unique to this <br />property nor out of the applicant's control. <br />Granting of the proposed variances would appear to <br />serve as a convenience to the applicants and the <br />applicants have not demonstrated any reasonable <br />hardship or practical difficulty. <br />The conditions and zoning code limitations imposed <br />on and existing on this property generally apply <br />to all other land and structures in the zoning <br />district in which this property is located. <br />The granting of this application is not <br />necessary for the preservation and enjoyment of <br />substantial property right of the applicants. <br />Denial of substantial additions to an existing <br />legal non-conforadng structure is not considered <br />by Council to be denial of a substantial property <br />right, especially when such additions in and of <br />themselves do not meet all current zoning <br />requirements. <br />Page 4 of B
