The property was platted in the 1980s as a <br />conforming 2 acre lot. When MnDOT conducted the Highway 12 project the parcel was taken over <br />by MnDOT as right-of-way to use for staging and support for the construction of the highway. In <br />2022, MnDOT listed a portion of the property for sale but kept a portion of the land as right way. As <br />a result, the remaining land is substandard in size (1.7 acres) within the RR-1B, 2 acre zoning district <br />right-of-way. The new property owners are moving forward with a new home project on the site <br />and a lot area variance is needed because it is a substandard lot for the zoning district. <br /> <br />Practical Difficulties Analysis <br />Applicant Submittal Information: The applicant has identified the lot being substandard due to the <br />right-of-way requirements of MnDOT as the primary practical difficulty supporting the requested <br />variance. Additionally, they have provided supporting documentation regarding Practical Difficulties, <br />attached as Exhibit C. <br /> <br />Planning Staff Practical Difficulty Analysis: Regarding practical difficulty, Staff agrees with the <br />applicant’s assessment as the land was first used by MnDOT to support the highway project and <br />kept a portion of the original parcel to support the Highway 12 right-of-way needs. The parcel of <br />land that was for sale was all that was available for the current property owners to purchase.
