ORONO COUNCIL MEETING HELD JANUARY 28, 1991 <br />NAYOR/COUNCIL REPORT-OTHER CONTINUED <br />time that may be most convenient for the Planning Commission to <br />meet with Council. <br />Kelley noted that the Planning Commission has scheduled a <br />work session for February 6, 1951 to discuss the Highway -2 issue <br />among themselves, and suggested including the Council. <br />Callahan stated that Council should first meet to reach a <br />consensus regarding their position on the various issues. <br />Council agreed that they would work with Staff and Planning <br />Commission to determine a date to hold the work session. <br />Jabbour stated that the City should be careful to schedule <br />Its meetings so that they do not conflict with the LMCD or <br />Highway 12 meetings. He said, 'I think it is essential for some <br />of us to attend those meetings." <br />CITY ADMINISTRATOR'S REPORT: <br />STRBBT CONVERSION ORDINANCE «92 SECOND SERIES <br />Bill wear was present and expressed his opposition to this <br />Ordinance. He said, "This is the second time the City has taxen <br />our property without paying us anything. The first time involved <br />easements taken for Old Crystal Bay Road. Now the City is taking <br />property that I am paying taxes on. Is it my understanding that <br />the City is now taking over all private roads?" <br />Mayor Peterson replied, "No, the City is not taking over all <br />private roads." <br />Mr. VJear said, "So the City is discriminating against me and <br />taking just this one." <br />Mayor Peterson asked the City Attorney to respond to Mr. <br />Wear's question. <br />Barrett replied, "Yes, that is correct. It is a form of <br />discrimination, but it is legal." <br />Mr. Wear said, "We* 11 see if it is legal, we're going to <br />test that. We have every intention in the world of getting paid <br />for it." <br />Jabbour clarified, "The City is not discriminating against <br />Mr. Wear, but rather against this particular street." <br />Mr. Wear reiterated that he is paying taxec on this road, <br />which is an outlot. <br />Jabbour said, "Mr. Wear would be relieved of any <br />- 15 -
