.8-Wiv-O CITY OF ORONO <br /> OPIL <br /> RESOLUTION OF THE CITY COUNCIL <br /> �F <br /> tNO. 7476 <br /> `-/ .ESHO <br /> A RESOLUTION <br /> APPROVING VARIANCES FROM <br /> MUNICIPAL ZONING CODE <br /> SECTION 78-570 & 78-1438 <br /> FILE NO. LA24-000015 <br /> WHEREAS, on March 11, 2024, Patrick Sutter and Anne Sutter, a married couple, <br /> (hereinafter the "Applicants"), applied for variances from the City Code for the property addressed <br /> 200 Big Island and legally described as: <br /> Lots 25 & 26, Morse Island Park, Hennepin County, Minnesota (hereinafter the <br /> "Property"); <br /> WHEREAS, the Applicant has made an application to the City of Orono for a variance to <br /> Orono Municipal Zoning Code Section 78-570 to allow reduced side yard setbacks, 26.9' on the <br /> north and 26.5 feet on the south where 30 feet is required; and <br /> WHEREAS, the Applicant has made an application to the City of Orono for a variance to <br /> Orono Municipal Zoning Code Section 78-1438 to allow less than a 10-foot separation between <br /> the new cabin and an existing shed/outhouse; and <br /> WHEREAS, on April 15, 2024, after published and mailed notice in accordance with <br /> Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at which <br /> time all persons desiring to be heard concerning this application were given the opportunity to <br /> speak thereon; and <br /> WHEREAS, on April 15, 2024, the Planning Commission recommended approval of the <br /> variance; and <br /> WHEREAS, on May 13, 2024, the City Council reviewed the application and the <br /> recommendations of the Planning Commission and City staff; and <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota <br /> hereby approves the requested variances as described above based on one or more of the <br /> following findings of fact concerning the Property: <br /> 1 <br />
