D. LAKE USE COMMITTEE. Chair Pillsbury <br />1) Approval of Minutes. Pillsbury <br />seconded, approval of the minutes of the Lake <br />meeting of 11-26-90. Motion carried unanimously. <br />moved, Foster <br />Use Committee <br />Resources <br />BHl Appeal - Freeman vs. Commissioner of Natural <br />Pillsbury moved, Foster seconded, to approve an appeal, <br />detailed memorandum of 11/15/90 explaining the appeal, of the <br />court's ruling not to rescind Freeman’s boating privileges and <br />the imposition of the $500 fine, ruling evidence did not prove <br />the defendant refused the BWI test. Motion carried unanimously. <br />3) Commendation <br />Pillsbury moved, Foster seconded, to commend the <br />Hennepin County Sheriff’s Department for national accreditation <br />of their law enforcement operations, the first such Sheriff’s <br />Department in the state to be so accredited. Motion carried <br />unanimously. <br />MN' DNR Bill for an Act Regulating Personal <br />Watercraft <br />Foster moved, Pillsbury seconded, to forward to MN DNR <br />the LMCD endorsement of the proposed Bill for an Act Regulating <br />Personal Watercraft, recommending the following ciianges and <br />addition: <br />Section 3, Subd. 1 (3) to read - within 150 feet of any <br />shoreline, dock, swimmer or other moored or anchored watercraft <br />at greater than slow-no wake speed. Section 3 Subd. 1 - Add a <br />new Section 0) renumbering remaining sections: To buss, chase or <br />spray any other watercraft. <br />The endorsement is to be accompanied by a letter to the <br />MN DNR also suggesting incorporation of the LMCD provisions <br />j^agarding prolonged operation in the same area. <br />Motion carried unanimously. <br />5) Amendment to Code 3.041, Subd <br />Regarding Flotation Devices. <br />2 and Subd. 9 <br />Foster moved, Rascop seconded, to adopt Ordinance No. <br />113, An Ordinance Relating to Personal Watercraft Flotation
