v�'r�a:;c � <br /> CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> NO. 6 4 7 6 <br /> ICESHO� <br /> A RESOLUTION <br /> GRANTING VARIANCES <br /> FROM ORONO MUNICIPAL CODE <br /> SECTIONS 78-350 and 78-1700 <br /> FILE NO. 14-3698 <br /> WHEREAS, Jay S. Hulbert Trust, (hereinafter the "Owner") is the owner of <br /> the property located at 3035 Casco Point Road within the City of Orono (hereinafter "City") <br /> and legally described as: All of Tract A, Registered Land Survey No. 394, Hennepin <br /> County, Minnesota, except that part lying Northerly of the following described line: <br /> Beginning at the Southeasterly corner of Tract B in said registered Land Survey; <br /> thence Southwesterly along a line drawn through a point on the Base line shown on <br /> said Registered Land Survey 80 feet Northwesterly from its intersection with the <br /> Southeasterly line of said Tract A to the shore of Lake Minnetonka and there <br /> terminating (hereinafter"the Property"); and <br /> WHEREAS, Jay S. Hulbert, the trustee of the Jay S. Hulbert Trust (hereinafter <br /> the "Applicant') on behalf of the Owner the Applicant has made application to the City for a <br /> variance from Orono City Code Section 78-350 which requires a 10-foot side setback to <br /> permit construction of an addition to the existing home over an existing deck 8.5 feet from the <br /> side property line; and <br /> WHEREAS, the Applicant has made application to the City for a variance from <br /> Orono City Code Section 78-1700 to permit 7,948.6 square feet (33.6%) hardcover on the <br /> property where 5,915.5 square feet or 25% hardcover permitted and 8,106.2 square feet <br /> (34.2%) currently exists in conjunction with construction of the proposed addition and stair; <br /> and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission <br /> held a public hearing on November 17, 2014, at which times all persons desiring to be heard <br /> concerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #14-3698. <br /> 2. The Property is located in the LR-1C zoning district, where 0.5 acres is the <br /> minimum lot area and 100 feet is the minimum lot width. <br /> Page 1 of 5 <br />
