' �0�� <br /> C ITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> ��'l,, �G~�` N o. 6 4 4 8 <br /> kESHOS� <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby grants the following: a <br /> variance from Orono City Code Section 78-350 to permit construction of an addition to the <br /> home 12 feet from the side street proeprty line where a 15-foot setback is normally requried; <br /> and a vairance from Orono City Code Section 78-1685 to allow constrcution of the 145 <br /> square foot addition to the home and of a 144 square foot shed resulting in a total of 16.9% <br /> structural coverage (242 square feet over the allowed 15% structural coverage level); subject <br /> to the conditions listed below: <br /> 1. Council approval is based on the survey, building and landscape plans submitted by <br /> the Applicants and annotated by City staff, attached to this Resolution as Exhibit A, <br /> B and C. Any amendments to these plans may require further Planning Commission <br /> and City Council review. <br /> 2. Hardcover shall not increase above 25% as allowed in Tier 1. The Applicants are <br /> hereby notified that any changes to the plans or the Property which result in an <br /> increase in hardcover above the approved level will require further Planning <br /> Commission and City Council review. <br /> 3. The Applicants shall provide the City with a recorded copy of the corrected utility <br /> easement prior to the issuance of a building permit. <br /> 4. The shed shall conform to City Code Section 78-1440 regarding consistent exterior <br /> materials with the principal structure. <br /> 5. The opening for doors on the proposed shed shall be less than 6-feet in width; no <br /> driveway hardcover is permitted to be installed to serve the shed. <br /> 6. The Applicants shall install or maintain existing vegetative screening around the shed <br /> to reduce the appearance of massing from the adjacent properties. <br /> 7. Authorities granted by this resolution run with the Property not with the Applicants, but <br /> are permissive only and must be exercised by obtaining building permits for the new <br /> construction of the addition and shed, and commencing construction of said project. <br /> A framing inspection must be completed within one year of the date of Council <br /> approval, or the variances will expire on that date (September 22, 2015). <br /> 8. Violation of or non-compliance with any of the terms and conditions of this resolution <br /> shall constitute a violation of the zoning code, shall automatically terminate any <br /> authority granted herein, and shall be punishable as a misdemeanor. <br /> Page 4 of 6 <br />
