Cleveland Trust Dated 10/10/08, (hereinafter "the <br /> Owner") are the owners of the property located at 4395 North Shore Drive within the City of <br /> Orono (hereinafter the "City") and legally described as: That part of Lots 9, 10, 11, and 12, <br /> Block 18, Saga Hill Revised, which lies westerly of the flowing described line, and its <br /> extensions: Commencing at the point of intersection of the West line of said Lot 9 with <br /> the shoreline of Lake Minnetonka; thence on an assumed bearing of North 1 degree 53 <br /> minutes East along the West line of said Lot 9 to the Northwest corner of said Lot 9; <br /> thence easterly a distance of 233.50 feet along a curve not tangential with the last <br /> described line, said curve is concave to the South, has a radius of 1043.0 feet, a central <br /> angle of 12 degrees 49 minutes 37 seconds and a the chord of said curve bears South 76 <br /> degrees 05 minutes 32 seconds East to the point of beginning of the line being <br /> described; thence South 11 degrees 05 minutes 18 seconds West to the shoreline of <br /> Lake Minnetonka, and said line there ending, Hennepin County, Minnesota (PIN 07-117- <br /> 23-43-0028) (hereinafter the "Property"); and <br /> WHEREAS, Bradley A. Cleveland, the trustee of the Bradley A. Cleveland Trust <br /> Dated 10/10/08 (hereinafter the "ApplicanY') on behalf of the Owner has made application to the <br /> City of Orono for a conditional use permit (hereinafter the "CUP") pursuant to Orono Municipal <br /> Zoning Code Section 78-966 to allow grading for construction of a new lake access pathway <br /> and stair system in conjunction with removal the existing stairs within the 75-foot setback on the <br /> Property; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the Orono, Minnesota, City Code, a public hearing was held by the <br /> Orono Planning Commission on August 18, 2014 at which times all persons desiring to be heard <br /> concerning this application were given the opportunity to speak thereon. <br /> Page 1 of 5 <br />
