A RESOLUTION GRANTING <br />A VARIANCE TO MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 2 <br />PILE #1770 <br />WHEREAS, Bill and Laurie Cornelius (hereinafter "the <br />applicants") are owners of the property located at 960 Tonkawa <br />Road within the City of Orono (hereinafter "City") and legally <br />described cs follows: <br />refer to Exhibit A enclosed, (hereinafter "the property"); <br />cind <br />WHEREAS, the applicants have applied to the City for <br />variances to Municipal Zoning Code Section 10*22, Subdivision 2 <br />to periP.it the construction of a new residence and a grade level <br />lakeside pool to be installed in front of the average lakeshore <br />setback line where no such encroachment is allowed by ordinance. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1770. <br />2* The property is located in the LR-IB, Lakeshore <br />Residential Zoning District requiring one acre in area. <br />The subject property consists of 2.8 acres. <br />3. The Orono Planning Commission reviewed this application <br />on October 19, 1992, and recommended approval of the <br />proposed variances based upon the following findings: <br />A. The lakeshore lot has an unusual shape with <br />several lineal feet of curved shoreline area. <br />B. The house would have to be set back 270' if it was <br />to meet the average lakeshore setback line for the <br />property. <br />C. Over one-third of the 2.8 acre parcel is located <br />within the 0-75' setback area. <br />Page 1 of 4
