c) The existing drainage pattern of the property provides <br />for positive drainage to the lake over extensive <br />grassed yard areas. <br />d) The proposed improvement of the property will also <br />result in a decrease in hardcover within the 0-75' <br />setback area, reduced from 11.7% to 10%. <br />e) The current residence does not have a garage nor a <br />basement area to provide additional storage area. <br />f) The proposed street setback for tne detached garage <br />will prevent the cutting into of the existing root <br />system of a group of trees well over 100 years old <br />located in the east yard area. <br />4. The City Council finds that the conditions existing on this <br />property are peculiar to it and do not apply generally to <br />other property in this zoning district; that granting the <br />variance would not adversely affect traffic conditions, <br />light, air nor pose a fire hazard or other danger to <br />neighboring property; would not merely serve as a <br />convenience to the applicant, but is necessary to alleviatt <br />a demonstrable hardship or difficulty; is necessary to <br />preserve a substantial property right of the applicants; and <br />would be in keeping with the spirit and intent of the Zoning <br />Code and Comprehensive Plan of the City. <br />5, The City Council has considered this application including <br />the findings and recommendations, reports by City staff, <br />comments by the applicants and the effect of the proposed <br />variances on the health, safety and welfare of the <br />community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the findings noted above, the <br />Orono City Council hereby grants variances to Municipal Zoning Code <br />Section 10.22, Subdivision 2 and Section 10.24, Subdivision 5 (B) that <br />would permit the construction of a detached garage to the location <br />within the street yard of the property subject to the following <br />conditions: <br />Page 2 of 6
