Date: April 22, 2024 Item: 6 <br />Presenter: Laura Oakden, Community Development Director <br />Section: Consent Agenda <br /> <br />Title: 485 Orono Orchard Rd S, Assent to Registration and Row of Way Easement <br />Agreements- Resolution #7474 <br /> <br /> <br />1.Purpose: <br />To accept the title registration and the two right of way easements from 485 Orono Orchard Rd S <br />abutting the property along Orono Orchard Rd and Fox Street. <br />2.Background: <br />The owner of the property at 485 Orono Orchard Rd S is in the process of registering the property. <br />Currently there are inconsistencies in the legal description resulting in property lines which do not <br />connect. A review of the title work determined that there were inconsistent right of way easements <br />along Fox Street and Orono Orchard Rd S. In order to fix the property line discrepancy they need <br />approval by the City Council to register the updated legal description. The applicant agrees to <br />grant the necessary right of way easements to the City over the the existing roadways. <br />3.Analysis: <br />Staff has been working with the City Attorney and determined that registering the updated legal <br />description is minor and will not be in conflict with city regulations. Staff notes it is beneficial to <br />obtain proper easements over the existing roadways. <br />4.Staff Recommendation: <br />Staff recommends approval of Resolution 7474, to accept the drafted right of way easement on <br />Orono Orchard Rd and Fox Street and to allow registration of the property. <br />AGENDA ITEM <br /> <br /> <br /> <br /> <br /> <br /> <br />COUNCIL ACTION REQUESTED <br />Motion to approve Resolution 7474. <br />Exhibits <br />Ex A.
