April 9, 2024 7 <br /> <br />T. Title and Signing Authority. City warrants that it will own good and marketable <br />title to all property in which City provides public trailway easement or real property <br />rights to Park District and that the undersigned is authorized to execute this <br />Agreement. <br /> <br />U. Enforcement. In the event either party should bring an action to enforce the terms <br />of this Agreement, the prevailing party shall be entitled to recover from the other <br />all of the legal or other expenses of the prevailing party, including reasonable <br />attorneys’ fees, and to have the same awarded as part of the judgment in the <br />proceeding in which legal expenses and attorneys’ fees were awarded. <br /> <br />V. Notices.
