�°�o <br /> C ITY OF ORONO <br /> RESOLUTION OF THE CIT'Y COUNCIL <br /> � � <br /> � ~ No. b � , 2 <br /> �' G <br /> t�KFSH��� <br /> A RESOLUTION <br /> GRANTING AN EXTENSION OF SITE PLAN AND <br /> CONDITIONAL USE PERMIT APPROVALS <br /> FOR PROPERTY LOCATED AT <br /> 450 OLD CRYSTAL BAY ROAD NORTH <br /> GRANTED VIA RESOLUTION NO. 6312 <br /> FILE #13-3589 <br /> WHEREAS, the City of Orono is a municipal corporation organized and existing <br /> under the laws of the State of Minnesota; and <br /> WHEREAS, the City Council of the City of Orono (hereinafter "City Council") has <br /> adopted land development regulations for the orderly, economic and safe development of land <br /> within the City; and <br /> WHEREAS, on August 26, 2013 the City Council approved Resolution No. 6312 <br /> granting the following: Industrial Site Plan Approval to allow improvements to the parking areas <br /> and to construct an addition to and conduct modifications to the existing building; a CUP <br /> approval to allow deferment of construction of 62 (of the required 101) parking stalls; a variance <br /> to locate the deferred stalls off of the Property at 550 Old Crystal Bay Road North which is also <br /> owned by the Owner; a setback variance from the requirements of City Code Section 78-827 to <br /> permit the proposed parking area to be set back 6 feet from the existing building where a 10 foot <br /> setback is required for the Property; and <br /> WHEREAS, Pine Corner Properties LLC, (hereinafter the Owners) requested a <br /> 12-month extension of the approvals granted under Resolution No. 6312 for property located at <br /> 450 Crystal Bay Road North and legally described as follows: LOT 1, BLOCK 1, CRYSTAL BAY <br /> BUSINESS CENTER 2ND ADDITION, Hennepin County, Minnesota (hereinafter the "Property"); <br /> and <br /> WHEREAS, the City Council has considered the request by the Owners for a 12- <br /> month extension of the approvals granted under Resolution No. 6312 for development of the <br /> Property; and <br /> WHEREAS, the Owners were not able to commence construction within the <br /> allotted one-year established by Resolution No. 6312; and <br /> WHEREAS, the approvals granted by Resolution No. 6312 expire on August 26, <br /> 2014; and <br /> Page 1 of 3 <br />
