Date: April 15, 2024 Item: 5.4 <br />Presenter: Natalie Nye, Planner <br />Section: Public Hearings <br /> <br />Title: LA24-000016, Steve Fisher, 3339 Crystal Bay Road, Variances (Natalie <br />Nye) <br /> <br /> <br />1.Purpose: <br />The applicant is requesting variances from average lakeshore setback, 75-foot lake setback, <br />hardcover within the 75-foot setback, overall hardcover, rear yard setback and driveway width in <br />order to construct an addition to an existing home. <br />2.MN§15.99 Application Deadline: <br />The application was received on March 14, 2024 and deemed complete on March 25, 2024. The <br />60-Day timeline for review will expire on May 24, 2024 <br />3.Background: <br />The subject property is substandard in size and width and the current home on the property is <br />nonconforming. The 75-foot setback and the average lakeshore setback bisect the current home. <br />Also, the hardcover on the property exceeds the maximum allowed. The applicant is proposing to <br />construct an addition to the existing home and a new front porch. The addition will include an <br />additional garage stall on the first floor and a screened in porch on the second floor as well as a <br />covered front porch. The proposed addition increases the overall hardcover on the site and <br />increases the amount of hardcover within the 75-foot lake setback. The addition will be built <br />within the 75-foot setback and in front of the average lakeshore setback line. <br />4.Staff Recommendation: <br />Staff recognizes the constraints of the substandard lot with an existing nonconforming home. <br />However, staff believes the homeowner has reasonable use of the property and the application is <br />not supported by practical difficulty.
