conditional use permit. This will allow the DNR and <br />other interests to comment as there will be a 10 day <br />notification period before the conditional use permit <br />can be acted upon. Since the residential districts <br />within the city do not approach the 25% impervious limit <br />and the commercial districts do not cover a very <br />substantial area of Tonka Bay, the city will never <br />average above 25% impervious cover in its shoreland area. <br />The maximum allowable impervious surface coverage under <br />the "old” state shoreland rules was 30%. <br />3. Increase in the structure height limit. ^ The statewide <br />standards require that a 25 foot height limit be applied <br />to all new structures in residential land use districts <br />in cities. The city is requesting the use of flexibility <br />to allow structures a height limit of 30 feet in <br />residential land use districts to keep many currently <br />existing residences already constructed beyond the 25 <br />foot limit from becoming nonconforming structures. The <br />city is proposing a conditional use permit for structure <br />that exceed 30 feet in height. The maximum allowable <br />structure Height under the "old" state shoreland rules <br />was 35 feet. <br />Tonka Bay has presented the above requests for review and <br />discussion by DNR and representatives of 11 Lake Minnetonka cities <br />who are working together as a Technical Review Committee for the <br />purpose of reviewing and discussing individual city's flexibility <br />requests affecting Lake Minnetonka . No problems with the city's <br />request have been noted at any of those meetings. <br />As stated earlier, please have appropriate staff review the <br />proposed flexibility request and, if necessary, provide your <br />comments to me at the address listed above within 45 days.
