Briefly, <br />the applicant requests after-the-fact approval for construction of an <br />accessory storage shed on a property with no principal structure, and <br />requesting a variance for a setback from the side street lot line of <br />5.9' where a 50' setback would normally be required. <br />Planning Commission Recommendation <br />At their September 21st meeting. Planning Commission voted 7-0 <br />for approval of setback variances to allow the 12'xl6' shed to remain <br />at its as-built location, and granting a variance to allow such <br />accessory structure on this outlot with no principal structure. <br />Planning Commission determined that one accessory structure on <br />this outlot is appropriate but any additional accessory structures <br />would not be looked at favorably. Planning Commission further <br />suggested that the resolution reflect that this is a unique outlot <br />situation in which three immediately adjacent property owners control <br />the use of the outlot, providing sufficient control of the site to <br />justify allowing an accessory structure without a principal structure <br />in this specific case. <br />Planning Commission recommended payment of after-the-fact <br />investigation fees for the zoning application and building permit, and <br />that the shed be brought into compliance with building code <br />requirements for such a structure. <br />Staff Recommendation <br />Staff recommends approval per the Planning Commission <br />recommendation. A resolution is attached for Council adoption.
