A RESOLUTION GRANTING <br />AFTER-THE-FACT VARIANCES TO MUNICIPAL ZONING CODE <br />SECTIONS 10.25, SUBDIVISION 6 (B); <br />10.22, SUBDIVISION 2; 10.56, SUBDIVISION 16 (L); <br />10.03, SUBDIVISION 14 (C); 10.03, SUBDIVISION 12; AND <br />A CONDITIONAL USB PERMIT PER <br />SECTION 10.03, SUBDIVISION 10 <br />- FILE #1755 <br />WHEREAS, Leonard Niska (hereinafter "the applicant") is the <br />owner of the property located at 2304 Shadywood Road within the City <br />of Orono (hereinafter "City") and legally described as follows: <br />Exhibit "A" attached (hereinafter the '-property"); and <br />WHEREAS the applicant has made application to the City of <br />Orono to permit the construction of a 140 s.f. storage shed which <br />requires a variance to Municipal Zoning Code Section 10.25 Subdivision <br />6 (B) to allow a 5' side street setback where a 15' setback is <br />normally required, a variance per the same section to allow a front <br />setback of 20* where a 30' setback is normally required, and a <br />variance to Section 10.22, Suodivision 2 and Section 10.56, <br />Subdivision 16 (L) to allow 41.1% hardcover where 35% hardcover is <br />normally allowed, and a variance to Section 10.03, Subdivision 14 (C) <br />to allow lot coverage by structures of 25.8% where only 15% lot <br />coverage is normally allowed, and a variance to Section 10.03, <br />Subdivision 12 to allow a structure-to-structure setback of 3' where a <br />10' setback is normally required, and requesting a conditional use <br />permit per Section 10.03, Subdivision 10 to allow an accessory <br />structure on a through lot. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota : <br />FINDINGS <br />1. This application was reviewed as Zoning File #1755. <br />2. The property is located in the LR—iC Single Family Lakeshore <br />Residential Zoning District. <br />3.
