CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono <br />City Council hereby grants a conditional use permit per Municipal <br />Zoning Code Section 10,03, Subdivision 10 and a variance to <br />Section 10.03, Subdivision 9 (E) that would approve an accessorcy <br />structure to be placed in the street rear yard of the property <br />that will conform to all required setbacks except to the north <br />side lot line to be located 13' instead of the required 15', <br />subject to the following conditions; <br />1. <br />2. <br />3. <br />4. <br />5. <br />Upon application for a building permit, applicant shall <br />provide an updated survey locating detached structure <br />at 25' X 36' located 35' from rear street yard, 15' <br />from south lot line and 13' from north side lot line. <br />Applicant must obtain a demolition permit for the <br />removal of the existing accessory structure. <br />Authorities granted by this resolution run with the <br />property not with the applicant, but are permissive <br />only and must be exercised by application for a <br />building permit within one year of the date of Council <br />approval, or this variance/conditional use permit will <br />expire on that date (September 28, 1993). <br />Violation of or non-compliance with any of the terms <br />and conditions of this resolution shall constitute a <br />violation of the zoning code, shall automatically <br />terminate any authority granted ’.erein, and shall be <br />punishable as a misdemeanor. <br />The undersigned applicant has read, understood and <br />hereby agrees to the terms of this resolution and on <br />behalf of himself, his heirs, successors and assigns, <br />hereby agrees to the recording of this resolution in <br />the chain of title '"f the property. <br />Page 3 of 5
