The most severe form of contamination is the underground <br />contamination with adjacent water tables that is never apparent with a <br />site inspection. Surfacing or leaching problems are less <br />objectionable as the effluent can still run over adjacent soils for <br />treatment. If the current system is failing, the drain would outlet <br />into adjacent lake. <br />Per Section 12.30, Subd. 6 (B), the applicant has not provided <br />confirmation that the guest house is served by a conforming septic <br />system. It is not the City's responsibility to confirm conformance <br />cr non-conformance of the system. At the time of the land use <br />application, it is the applicant's responsibility and to this date we <br />have received no confirmation as to design, location or size <br />system. <br />of <br />Weckman's final comment was how would you proceed with the <br />request from the next applicant? What is unique about this system or <br />property? It was noted that at your last meeting you approved tt 2 lot <br />subdivision and a requirement was that a r.on-conforming system was to <br />be replaced within one year of the final subdivision approval. This <br />system was deemed non-conforming because of a 6' setback from a <br />t*'*veled road and because of the age of the system, the required <br />separation setback was not met. The applicant could also not provide <br />information that the system was conforming and therefore was required <br />to Bieet current code standards. <br />IPlanolnq Coasiisaion Recomaendation <br />To approve the conditional use permit for the continued guest <br />house use of the second residential structure on the property located <br />at 1605 Fox Street finding that all area requirements for the guest <br />house use have been met. Approval is subject to the following <br />conditions: <br />1. Guest hoMSt. structure is considered a non-conforming <br />structure. Baaed on its substandard side setback at 10* and <br />substandard lakeshore setback at approxisiately 70', any <br />major structural repair of this structure or expansion of <br />the structure will require variance approval of the City of <br />Orono. <br />2. The guest house is for the exclusive use of applicant, <br />guests or hired help and may never be used for rental <br />purposes. <br />3. Applicant must Install a conforming septic aystem to serve <br />the guest house within one year of Council's approval of the <br />ccnditional use permit.
