Applicant at that time questioned Council as <br />to possible adjustment in the park dedication fee to reflect a <br />monetary value for the trail easement being granted over the 10' <br />drainage and utility easement adjacent to roadway. Council concurred <br />and directed staff to refer the matter to the Park Commission for <br />further study and final recommendation to the Council. At the July <br />6th meeting of the Park Commission, refer to Exhibit B, the Park <br />Commission voted to take the full park dedication fee and to not <br />request a trail easement over the drainage and utility easement as <br />originally required. <br />Members may remember that Mrs. Sweetser was very anxious to complete <br />the filing and all documentation approving the final plat were filed <br />and the property sold to an adjacent property owner, Bruce Dayton. <br />The enclosed documentation will allow the trail easement to be <br />extinguished over the drainage and utility easement. All parties with <br />an interest are in the process of executing the newly amended <br />easement. The City Attorney's office has prepared the necessary <br />consent form (Exhibit C) to accompany the amended easement at the time <br />of filing. <br />Staff Recomendation <br />Tc approve the filing of an amended drainage and utility easement for <br />Hilltop Farm and to direct the Mayor and Clerk to execute the consent <br />form. <br />ch
