The original house was razed in May of <br />1991 as a result of a hazardous building action. The property <br />has been assessed for sewer and a SAC payment was made in 1988. <br />There is no record of the location of the original house on the <br />property but it was approximately in the same alignment of the <br />existing residences which would appear to be within 10 to 15' of <br />the street/front setback line. The proposed house will meet the <br />front 50' setback but will not meet the required side or rear <br />setbacks. Note the irregular east side lot line places deck <br />approximately 18+' from rear lot line. The principal structure <br />at that point is located 22'. <br />The property is not subject to hardcover regulations of the <br />City as property is not located within 1,000' of a protected lake <br />or tributary. The improvement plan meets the lot coverage <br />requirements as noted above. Staff has reviewed the files to see <br />if expenses charged against the property for the hazardous <br />building action have been paid. The files reveal that the amount <br />of $2,181.39 still remains to be paid to the City. Applicant <br />must make payment of the full amount upon application for a <br />building permit. The property consists of two independent <br />parcels and must be legally combined upon approval of the <br />variance application by the City. <br />The lot is a through lot. All future accessory structures <br />to be installed on the property will require a conditional use <br />permit. Access to the property will remain via Prospect Avenue <br />where lot is at its widest width at 93'. <br />Hardship Statement <br />Please review Exhibit A. Applicant notes that lot is less <br />than 1/2 acre in area and subject to 2 acre development <br />standards. The lot is typical in size of the surrounding <br />developed Crystal Bay neighborhood. A residence had existed on <br />the property before and the property is served with sewer and has <br />been assessed a single sewer unit. <br />Planning Commission Recommendation <br />The Planning Commission recommended unanimous approval of <br />the variances as proposed basing their approval on the hardships
