This house was constnicted in 1963 with a major addition in 1975. The pool <br /> was installed in 1971. This was before hardcover regulations were adopted. <br /> 3. The Planning Commission reviewed this application on October 16, 2Q06 and <br /> on a vote of 6 — 0 recommended approval of the variance, based on the <br /> following findin�s: <br /> a. The total amount of hardcover on the property will be reduced by 394 <br /> square feet. State statues would allow reconstruction of the patio and decic <br /> without any reduction of hardcover. <br /> b. The new hardcover would be within the 75 to 250 foot zone, which would <br /> have only 17.6 percent hardcover. It would be located at least 200 feet <br /> from the lake. <br /> c. As required in conjtulction with any Uuildin� pennit, weed control fabric <br /> and plastic will be renZoved from the property. This will reduce hardcover <br /> by 6,607 square feet. <br /> 4. The City Council has considered this application including the findings and <br /> recommendation of the Planning Commission, reports by City staff, cornments <br /> Uy the applicant and the public, and the effect of the proposed variance on the <br /> health, safety and welfare of the community. <br /> 5. The City Council finds that tl�e conditions existing on this property are pe-culiar <br /> to it and do not apply jenerally to other property in this zoning district; that <br /> �-anting the variance would not adversely aFfect traffic conditions, light, air <br /> nor pose a fire hazard or other danger to neighboring property; would not <br /> merely serve as a convenience to the applicant, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preseiti�e a substantial <br /> property right of the applicant; and would be in l:eepin� with tl�e spirit and <br /> intent of the Zoning Code and Comprehensive Plan of the City. <br /> CONCLUSIOi�'S, �R���A�i� C��TDITIONS <br /> Based upon the above findin�s, the Orono City Council herebv �rants a <br /> variance to Orono Municipal Zoning Code Section 7S-128� to allow rearran�ement oF <br /> PaRe 2 of� <br />
