Gaffron, Asst Planning & Zoning AdnAUSs£r4itld92 <br />July 28.. 1992 CITY OF ORONO <br />Proposed Ordinance Amendments/P.estructuring; <br />Section 9.21 - Public Nuisance <br />- (New) Section 9.23 - Participation in Noisy Parties <br />List of Exhibits <br />Exhibit A <br />Exhibit B <br />Exhibit C <br />Exhibit D <br />Code Prior to 5/9/88 <br />Ordinance No. 51, Second Series, Adopted 5/9/88 <br />Current Code <br />Proposed Ordinance <br />Summary <br />As a result of Mr. Callahan's proposal to place the <br />styrofoam ordinance in Chapter !> (Public Protection, Crimes and <br />Offenses), and the subsequent cJiscussions in reference to the <br />public nuisance section of the code, staff reviewed the public <br />nuisance section and found it to be in disarray. <br />Subsection 9.21 referenced in the Styrofoam Ordinance, was <br />revised in 1988 at the request of Chief Kilbo and Mr. <br />Bernhardson, to include language relating specifically to <br />participation in noisy parties or gatherings. Unfortunately (and <br />apparently inadvertently), their ordinance had the effect of <br />deleting the prior language rather than adding to it. It is clear <br />from a review of the Council paclcet of May 9, 1988 that there <br />was no intent to drop the public nuisance definition language. <br />Apparently, neither Ed nor the City Attorney have updated <br />code booJcs. Therefore, when Ed referenced Section 9.21 as <br />providing a definitlDn of public nuisance, I was understandably <br />perplexed. <br />The solution is to readopt the language previously dropped <br />from Section 9.21, and, as initially suggested by City Attorney <br />Bryan Crawford in his letter of April 21, 1988, readopt the <br />"Noisy Parties" Ordinance as Section 9.23. <br />Staff Recommendation <br />Staff recommends approval of the proposed ordinances to <br />reinstate the public nuisance definition as Section 9.21 and <br />readopt the Noisy Parties Ordinance as Section 9.23. <br />Isv
