9.Overall lot coverage in the shoreland area shall not <br />exceed the surplus development capacity for impervious <br />surface coverage calculated for Lake Minnetonka, Gleason <br />and Peavey Lakes, as specified in the Wayzata <br />Comprehensive Plan/Shoreland Management Plan, as may be <br />amended. <br />10.All projects shall be in conformance with the Stormwater <br />Management Plan for the City of Wavzata. May 1988, as may <br />be amended and/or approved by the City Engineer. <br />11.All projects shall be in conformance with the Wayzata <br />Comprehensive Plan/Shoreland Management Plan, as may be <br />amended. <br />12.All projects shall be subject to the review of the <br />Minnehaha Creek Watershed District. <br />801.91.20:VARIANCE* Variances may be granted by the City Council <br />in accordance with Section 801.05 of this Ordinance in <br />extraordinary cases, but only when the proposed use is determined <br />to be in the public interest. The following additional criteria <br />shall apply within shoreland areas: <br />A.Result in the placement of an artificial obstruction which <br />shall restrict the passage of storm and flood water in such a <br />manner as to increase the height of flooding, except <br />obstructions approved by the U.S. Army Corps of Engineers in <br />conjunction with sound floodplain management. <br />B.Result in incompatible land uses or which shall be detrimental <br />to the protection of surface and ground water supplies. <br />C.Be not in keeping with land use plans and planning objectives <br />for the City of Wayzata or which shall increase or cause <br />danger to life or property. <br />D.Be inconsistent with the objectives of encouraging land uses <br />compatible with the preservation of the natural land forms, <br />vegetation and the marshes and wetlands within the City of <br />Wayzata. <br />E.Shall constitute a hardship as defined in Section 801.05 of <br />this Ordinance. <br />F.No permit or variance shall be issued unless the applicant has <br />submitted a Shoreland Impact Plan as required and set forth in <br />this Ordinance. In granting any variance, the City Council <br />may attach such conditions as they deem necessary to insure <br />compliance with the purpose and intent of this Section. <br />1
