Specific Standards. <br />1.When constructed facilities are used for storm water <br />management, documentation shall be provided by a <br />qualified individual that they are designed and installed <br />consistent with the field guidelines of the Minnehaha <br />Creek Watershed District. <br />2.Newly constructed storm water outfalls to public waters <br />shall provide for filtering or settling of suspended <br />solids and skimming of surface debris before discharge. <br />801.91.15:NON-CONFORMITIES: All legally established non­ <br />conformities as of the date of this Ordinance may <br />continue, but they shall be managed according to applicaUole state <br />statutes and regulations of Section 801.15 of this Ordinance <br />regulating non-conformities for the subjects of alterations and <br />additions, repair after damage, discontinuance of use, and <br />intensification of use, except that the following t: andards shall <br />also apply in shoreland areas: <br />A. Additional/Expansions to Non-Conforming Structures. <br />1.All additions or expansion* -.o “he outside dim.ensions of <br />an existing non-conforming structure shall meet the <br />setback, height, and other requirements of Section <br />801.91.8, 801.91.9 and 801.91.10 of this Ordinance. Any <br />deviation from these requirements shall be authorized by <br />a variance pursuant to Section 801.91.20 of this <br />Ordinance. <br />2.Deck additions may be allowed without a variance to a <br />structure not meeting the required setback from the <br />ordinary high water level if all of the following <br />criteria and standards are met: <br />a.The structure existed on the date the structure <br />setbacks were established; <br />b.A thorough evaluation of the property and stiructure <br />reveals no reasonable location for a deck meeting <br />or exceeding the existing ordinary high water level <br />setback of the structure. <br />c.The deck encroachment toward the ordinary high <br />water level does not exceed fifteen (15) percent of <br />the existing setback of the structure from the <br />ordinary high water level or does not encroach <br />closer than thirty (30) feet, whichever is more <br />restrictive; and
