Perimeter plantings have been removed and/or not <br />maintained, a violation of the 1975 Operations Plan <br />(Section 10.41, Subd. 7 and 14). <br />2.Property owner continues to maintain 143 slips in <br />violation of past City requirements allowing no more <br />than 134 slips (Section 10.41, Subd. 8 [B], Resolutions <br />1060 and 1161). <br />3.Property owner has failed to provide a 10* wide green <br />grass buffer strip along the shoreline, or <br />alternatively a runoff filtration system or berm <br />incorporated into the shoreline rip rap system, as <br />requested by the City in 1902 (Section 10.41, Subd. <br />11). <br />It was the Lake Use Ccwmiittee's recommendation that licenses be denied <br />besed on the noted violations. If Council conceptually agrees that <br />license denial is in order, staff would recommend that a resolution of <br />denial be drawn up for each marina, citing the specific violations <br />leading to denial. <br />Mem" oomfermAties/Pmst Approvsls/OrJi nance Imedeqmecies <br />The marinas have never complied with many sections of the B<-2 <br />ordinance because their non-conformities pre-existed adoption of <br />specific code sections. In past attempts to increase the degree of <br />conformity, the City has in many cases agreed to site-specific <br />variances related to yard requirements, landscape, parking and boat <br />storage locations, etc. <br />Further, it is clear that the ordinances do not address certain of the <br />concerns coming forth in recent years, i.e. *too many boats on the <br />property” with no code basis for limiting them or <tetermining how many <br />is too manyi lack of regulation of land-related charter boat <br />activities! or the land use and neighborhood impacts of boat clubs, <br />dryland storage, and other innovations. <br />•tnff ttiem <br />A.Licenses. If Council conceptually agrees that the licenses <br />for the three subject marinas should be denied, then direct <br />staff to draft denial resolutions for adoption. <br />B.The Lake Use Committee should be encouraged to work with <br />staff and the marina operators to devise code revisions <br />which will address new concerns while providing a mechanism <br />for upgrading existing non-conformities without relying on <br />the trigger of a variance/CUP/building permit application. <br />Ji
