Thorfinnson <br /> 400 Marquette Bank Building <br /> 6640 Shady Oak Road <br /> Eden Prairie, MN 55344 <br /> Re: Reconstruction of Guest House at 1420 Bohn' s Point Road <br /> Dear Mr. Thorfinnson: <br /> In reviewing the after-the-fact permit application for work <br /> on the accessory structure at 1420 Bohn's Point Road (1418 Bohn's <br /> Point Road), it is clear that this structure is intended to serve <br /> as a second dwelling unit on the property. <br /> Because an entirely new foundation was placed under this <br /> structure, the building is considered as a "new" structure, and <br /> must meet all req�irements of the zoning code. <br /> The structure in question appears to meet the required <br /> front, side and rear setbacks for a detached accessory structure, <br /> but the use of that structure is further regulated in the zoning <br /> code. Such a detached structure could take on either the <br /> character of a storage building, or the character af a guest <br /> house. Because the obvious intent is that this become a dwelling <br /> unit with plumbing and kitchen facilitie�'Zoninn Code Section <br /> Permit for guest house use is required, p g <br /> 10.20 , Subdivision 3 (G). <br /> No building permits for the work already done or yet to be <br /> comp leted can be issued until a Conditional Use Permit for guest <br /> house use is applied for and approved by the City Council. I <br /> have attached the appropriate zoning code sections, along with <br /> the conditional use permit application form. <br /> Please note that the application and alI required submittals <br /> must be in this office by noon on Friday, August 25th in order to <br /> be scheduled for a public hearing at the Planning Commission <br /> meeting of September 18th. The earliest pvssible date of final <br /> action by the Council on this would be October 9, 1989.
