In follow up to our conversation you had suggested that I send a <br />personal email with my perspective and I appreciate the opportunity to do so. <br />In summary, we contracted with Outdoor Excapes to perform our landscaping project and assure that everything <br />is constructed to code and within survey boundaries, etc. Unfortunately, the area that was constructed to be a <br />site where we could place several raised planter beds was positioned such that the latter half of the wall on the <br />right (see picture below) is encroaching 2 feet into the Utilities and Drainage easement per the survey (see <br />second picture below). <br />I am asking that the city council agree to an encroachment agreement for the portion of the wall that is 2 feet <br />over the boundary. As the utilities come in from a different direction into the lot and the rest of the area around <br />our property is protected wetlands, I don’t see a time when the city would ever need to use that land on our <br />property and we would certainly agree to have the wall moved if that ever became an issue in the future. <br /> Additionally, the flattened bed area actually slows drainage towards the wetlands and ultimately, those 2 feet <br />of encroachment should never cause an imposition to other parties. <br />However, I do also see your points too and I can appreciate from the city’s perspective that it is frustrating to <br />have a contractor not assure all the rules are followed. Honestly, I am very frustrated that the wall was <br />constructed without fully taking into account the boundary as I feel like part of what I paid for was to assure that <br />everything was build to code. I never had any intention to have any encroachments and fully intended to have <br />my contractors follow all the rules. Ultimately, if Outdoor Excapes is forced to move the wall it will create a lot <br />of disruption and damage to the surrounding landscaping that has already been done (as they will need to bring <br />in some heavy equipment to do so) and could also potentially harm some of the nice trees that we had brought in <br />as well. I am asking that the City show us some mercy on this one and let everyone move on by agreeing to the <br />2 feet of encroachment. I would love to have this resolved too so our family can move forward with planting a <br />garden this spring. <br />Thanks again for your time and consideration, <br />Paul Scott <br />172
