Date: April 8, 2024 Item: 14 <br />Presenter: Natalie Nye, Planner <br />Section: Consent Agenda <br /> <br />Title: LA24-000012, Robert Breon, 2700 Casco Point Road, Variances - <br />Resolution 7465 <br /> <br /> <br />1.Purpose: <br />This application is regarding variances for lot area, lot width, front yard setback and side yard <br />setback in order to construct a new home with a connection to an existing nonconforming detached <br />garage. <br />2.MN§15.99 Application Deadline: <br />The application was received on February 21, 2024 and considered to be complete of February 23, <br />2024. Therefore, the 60-Day review period expires on April 23, 2024. <br />3.Background: <br />The applicant is proposing to demolish the existing home on the property and keep an existing <br />two-story detached garage. The existing detached garage is nonconforming as it relates to front <br />yard and side yard setbacks. The applicant is proposing to construct a new home that connects to <br />the existing nonconforming structure and requests variances from front and side yard setback <br />requirements as the home will be 20 feet from the front property line and 2.4 feet from the side <br />property line. The subject property is nonconforming in lot width and lot size for the LR-1C <br />zoning district and therefore for the construction of a new home to take place on the property, <br />variances from lot width and lot size are also required and requested. <br />4.Planning Commission Vote and Comment: <br />The Planning Commission held a Public Hearing on March 18, 2024. The Planning Commission <br />discussed the application and determined that there were practical difficulties present on the lot <br />that support the requested variances. The Planning Commission specifically reviewed the <br />expansion of the second story above the existing garage footprint, finding that it was reasonable <br />and therefore supported the application as applied. The Planning Commission voted 4 to 0 to <br />approve the requested variances as applied. <br />5.Public Comment: <br />Staff received letters from a concerned neighbor that was included in the Planning Commission <br />packet. The two neighbors on either side of the subject property spoke at the Public Hearing. <br />Neither neighbor had issues with the proposed home or variances requested. The neighbors <br />brought up concerns regarding construction traffic, cleanliness of the site, and a retaining wall <br />proposed near a property boundary.
