Date: April 8, 2024 Item: 12 <br />Presenter: Natalie Nye, Planner <br />Section: Consent Agenda <br /> <br />Title: LA24-000009, Revision LLC, 797 Ferndale Road N, Variances - Resolution <br />7463 <br /> <br /> <br />1.Purpose: <br />This application is regarding an average lakeshore setback variance in order to construct a new <br />single-family home on a vacant lot. <br />2.MN§15.99 Application Deadline: <br />This application was received on February 20, 2024 and considered to be complete on February <br />23, 2024. Therefore, the 60-Day review period expires on April 23, 2024. <br />3.Background: <br />The subject property is currently vacant. The property is uniquely shaped and fronting on Lydiard <br />Lake. Strict adherence to the average lakeshore setback creates an unbuildable lot. The applicant is <br />proposing to construct a new single-family home on the property, adhering to all other zoning <br />requirements. <br />4.Planning Commission Vote and Comment: <br />The Planning Commission held a public hearing on March 18, 2024. The Commission reviewed <br />the application and noted that the average lakeshore setback was extreme due to the placement of <br />the neighboring homes. The Commission found that the proposed home placement and height were <br />reasonable and voted 4 to 0 on a motion to approve the requested variance as applied. <br />5.Public Comment: <br />Staff received letters of concern from two neighboring properties regarding the application. These <br />letters were included in the Planning Commission packet. These concerned neighbors also spoke at <br />the Public Hearing. A total of three neighbors provided comments at the Public Hearing on March <br />18, 2024. Expressed concerns included; the location of the proposed septic system, increased <br />hardcover, preservation of the natural environment, obstruction of currently enjoyed lake views, <br />construction traffic, and the shared driveway. <br />6.Staff Recommendation: <br />Staff finds there are practical difficulties present on the lot that prevent a compliant building <br />envelope.
