I'.,-fI <br />>>.r'fe. <br />kiMr ■tP^-‘ <br />EiS^ <br />ORDINANCE #SECOND SERIES <br />AN ORDINANCE TO AMEND THE MUNICIPAL ZONING CODE <br />SECTION 10.56, BY ADDING SECTION 10.56, SUBDIVISION 17 (T) <br />PROHIBITING THE USE OF NON-ENCASBD STYROFOAM <br />AS A DOCK FLOTATION DEVICE <br />-5\ V-I'ii. <br />^^,v-The City Council of Orono ordains as follows: <br />The Municipal Code of the City of Orono is amended by adding <br />Ordinance #_____, Second Series: <br />t?- i i <br />mp’-.ii. <br />.■> <br />mi 1^. g,.- <br />m <br />mm- <br />L/ 'l.Am <br />;r> <br />Section 1. Orono Municipal Zoning Code Section 10.56, <br />Subdivision 17 is amended by adding Subsection (T) to read as <br />followsi <br />(T)t Floating docks as platforms. Because the disintegration of <br />styrofoam dock flotation blocks leads to floating styrofoam beads <br />washing up onto the shoreline, causing a visual blight on the <br />shoreland landscape, and thereby creating a public nuisance, the <br />use of non-encased styrofoam blocks or sheets for dock and <br />platform flotation is prohibited subject to the following <br />regulations: <br />"Non-encased styrofoam " means any brand of expanded <br />polystyrene beads molded into a block, sheet or other <br />shape that does not have a permanent casing, covering <br />or coating which would eliminate disintegration of the <br />molded block or sheet into individual beads or chunks <br />as a result of ice action, animals or normal activity <br />by dock users. <br />2.This ordinance applies to all new, private and <br />commercial dock construction, regardless whether such <br />dock is permanent or seasonal in nature, occurring <br />after the date of adoption of this ordinance. <br />3.The owners of any existing permanent or seasonal dock <br />constructed with non-encased styrofoam shall <br />discontinue use of the non-encased styrofoam as a <br />flotation device per the following compliance schedule: <br />3 •No more than 2/3 of the length of a given dock may <br />be supported by non-encased styrofoam after <br />January 1, 1993. <br />b.No more than 1/3 of the length of a given dock may <br />be supported by non-encased styrofoam after <br />January 1, 1994. <br />c.No portion of any dock may be supported by non- <br />encased styrofoam after January 1, 1995. <br />" mi ?!tr.. <br />-ij>—w .A.It linirmJto 111 <br />1
