You may recall that Orono submitted our Ordinance <br />and Flexibility Request in February, received no negative <br />responses from other cities, and DNR staff have verbally <br />indicated they will accept our zero-setback for lockboxes based <br />on the justification we submitted. I was advised 2 weeks ago <br />that there may be some additional housekeeping items, but in <br />general they are accepting our code as presented. <br />As the other cities submit their proposed ordinances, most <br />will likely be requesting some form of flexibility. The <br />procedure is that they send their Flexibility Request to both the <br />OMR and all other Lake Minnetonka cities. We then have 45 days <br />to respond to the proposing city and/or DNR. DNR and the <br />proposing city then have 15 days to address any concerns raised <br />oy us. (If we make no response within that time frame, the DNR <br />will assume the proposed flexibility raquest is not <br />objectionable). <br />tfe are in receipt of Minnetrista's proposed Shoreland <br />Ordinance. The attached memo indicates the few areas in which <br />they request flexibility. <br />Please review Minnetrista's request. If you agree that <br />their Flexibility Request is reasonable and acceptable, no <br />response is required. You do have the option of taking a formal <br />vote indicating no objection to their ordinance or any others <br />that we see in the coming months, although that may serve no <br />Qg4fful purpose. If, on the other hand. Council finds Flexibility <br />Requests by other cities that Council feels should not be granted <br />by DM, then a fonral response would be appropriate. This «K>uld <br />most appropriately be in the form of a letter to the specific <br />city and the DNR. <br />Staff tion <br />Per the June 18 memo attached, staff recommends no objection <br />to the Minnetrista Shoreland Ordinance.
