The proposed armored swale, meandering stair with low walls within the 75- <br /> foot setback will not alter the essential character of the neighborhood and will <br /> result in minimal or no negative impact on adjacent properties. <br /> h. The sub-grade retaining walls will be hidden under the earth and beneath <br /> vegetation offering a natural looking shoreline from the lake. <br /> i. The installation of the sub-grade retaining walls will help to support the slope <br /> and, combined with the armored swale and vegetation plan should help to <br /> improve storm water quality and prevent further erosion from the site. <br /> j. The Owners have provided a landscape plan which will serve to stabilize the <br /> slope as well as screen views of the proposed improvements from the lake. <br /> k. The Owners have provided a plan to reorient the existing lake access path to <br /> the new stair system which results in 16 square feet less hardcover within the <br /> 0-75' zone. <br /> I. The Owners' request is in harmony with the purpose and intent of the <br /> ordinance, consistent with the comprehensive plan and will not alter the <br /> character of the area. <br /> 4. The City Council has considered this application including the findings and <br /> recommendation of the Planning Commission, reports by City staff, comments by <br /> the Owners and the public, and the effect of the proposed variances and <br /> conditional use permit on the health, safety and welfare of the community. <br /> 5. The City Council finds that the conditions existing on this Property are peculiar to <br /> it and do not apply generally to other property in this zoning district; that granting <br /> the variances and conditional use permit would not adversely affect traffic <br /> conditions, light, air nor pose a fire hazard or other danger to neighboring <br /> property; and would be in keeping with the spirit and intent of the Zoning Code <br /> and Comprehensive Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council grants: a <br /> variance from Orono Municipal Zoning Code Section 78-1279 to allow construction of a <br /> replacement lake access stair and new subterranean retaining walls within 75 feet of the OWHL <br /> of Tanager Lake repair ravines caused by erosion and stabilize the slope; and variances to <br /> Orono Municipal Zoning Code Sections 78-1288, 78-1680 and 78-1700 to allow new hardcover <br /> in conjunction with construction of a replacement lake access stair with low retaining walls within <br /> Page 3 of 5 <br />
