���o <br /> C ITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> � � <br /> � G1 N o. b 4 1 2 <br /> rAkFs Ho�� <br /> A RESOLUTION <br /> GRANTING VARIANCES FROM <br /> MUNICIPAL ZONING CODE <br /> SECTIONS 78-1279, 78-1288, 78-1680 & 78-1700 <br /> AND <br /> A CONDITIONAL USE PERMIT <br /> PURSUANT TO MUNICIPAL ZONING CODE <br /> SECTION 78-966, 78-967 & 78-1286 <br /> FILE NO. 14-3670 <br /> WHEREAS, Rodney P. Burweli and Barbara Elaine Burwell, husband and wife <br /> (hereinafter "the Owners") are the owners of the property located at 1100 Millston Road within <br /> the City of Orono (hereinafter the "City") and legally described as: Lots, 3, 4 and 5, Block 1, <br /> Millston, Hennepin County, Minnesota (hereinafter the "Property"); and <br /> WHEREAS, the Owners have made application to the City of Orono for a <br /> variance from Orono Municipal Zoning Code Section 78-1279 to allow construction of a <br /> replacement lake access stair and new subterranean retaining walls within 75 feet of the OWHL <br /> of Tanager Lake to replace an existing deteriorating stair, repair ravines caused by erosion and <br /> stabilize the slope; and <br /> WHEREAS, the Owners have made application to the City of Orono for a <br /> conditional use permit pursuant to Orono Municipal Zoning Code Sections 78-966, 78-967 and <br /> 78-1286 to allow grading for construction of subterranean retaining walls, new stair system and <br /> landscape plantings in conjunction with slope stabilization measures, to create an armored <br /> swale directing storm water toward the lake and removal of the existing stairs within 75 feet of <br /> the OHWL on the Property; and <br /> WHEREAS, the Owners have made application to the City of Orono for <br /> variances to Orono Municipal Zoning Code Sections 78-1288, 78-1680 and 78-1700 to allow <br /> new hardcover in conjunction with construction of a replacement lake access stair with low <br /> retaining walls within 75 feet of the OWHL of Tanager Lake where no hardcover is permitted; <br /> and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the Orono, Minnesota, City Code, a public hearing was held by the <br /> Orono Planning Commission on May 19, 2014 at which times all persons desiring to be heard <br /> concerning this application were given the opportunity to speak thereon. � <br /> Page 1 of 5 <br />
