Nelson, (hereinafter "the applicant") <br />is the owner of the property located at 500 Oxford Road within <br />the City of Orono (hereinafter "City") and legally described as <br />Lot 7, Block 1, Stielows Addition, Hennepin County, Minnesota <br />(hereinafter "property"); and <br />WHEREAS, the applicant has applied to the City of Orono <br />for a conditional use permit to permit the filling of over 100 <br />cubic yards at 2.5 to 1 slopes to the west side of an existing <br />pool that involves the removal of tiered retaining walls and the <br />insta 1 laton of 50 lineal feet of a 4’ high retaining wall along <br />the base of the fill area. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. <br />2. <br />This application was reviewed as Zoning File #1739. <br />The property is located in the LR-IA Lakeshore Single <br />Family Residential Zoning District requiring 2 acres <br />in area. The property consists of 2+ acres. <br />3.On June 15, 1992, the Orono Planning Commission <br />review d the application as proposed and recommended <br />approval based on the following findings: <br />a.The existing tiered retention wall is in a serious <br />state of disrepair and endangers existing <br />improvements located in the adjacent higher <br />elevations. <br />b.The proposed land alterations are located in the <br />central portion of the property and will have no <br />impact on adjacent residences. <br />Page 1 of 4
