Lake Use Committee Chairman Callahan agreed to present the issue <br />at the June 22nd Council meeting, and noted the City would not take <br />legal action regarding the 1991 fee prior to that meeting. <br />Please review the attached Minutes, memos, and correspondence. <br />To briefly review, in 1990 Gayle's Marina and North Shore Drive Marina <br />submitted their license applications with only the $200.00 base fee, <br />noting that due to low water they were unsure as to how many slips <br />they could put into service. <br />Pursuant to the staff memo of 4/10/90, Council discussed this <br />issue on 4/23/90. Minutes reflect that the consensus of the Council <br />was to waive the slip fees. No specific vote was taken. The question <br />of whether marinas who had already paid the full slip fees should have <br />them returned, was never brought up, nor was it made clear whether the <br />fee waiver was to be offered only to those who requested it. <br />Consequently, no other marinas were informed of nor offered the slip <br />fee waiver. <br />In 1990 Windward paid the full license fee. In 1991, Windward <br />made no 1991 license application until January 1, 1992. Mr. Rivers <br />indicated that less than 50% of his slips were rented out in 1991 due <br />to low water conditions and the slow economy.
