� o� <br /> O ,��,� O CITY of ORONO <br /> ,>�i, . <br /> �='- �� <br /> � ;��� <br /> � �� � ,,�?,�, D+ RESOLUTION OF jHE CITY COUNCIL <br /> �, �� �, �� � � j <br /> �� ` a; ;�� ti <br /> � NO. <br /> r�kESH04� <br /> A RESOLUTION <br /> GRANTING VARIANCES TO <br /> MUNICIPAL ZONING CODE <br /> SECTIONS 78-350; 78-1279; 78-1288; 78-1680 AND A <br /> CONDITIONAL USE PERMIT PURSUANT TO <br /> MUNICIPAL ZONING CODE SECTIONS 78-966 8� 78-1286 <br /> FILE NO. 14-3660 <br /> WHEREAS, AI John Hagen and Donna Mae Hagen, a married couple <br /> (hereinafter "the Applicants") are the owners of the property located at 3655 North Shore Drive <br /> within the City of Orono (hereinafter the "City") and legally described as: <br /> Attached as Exhibit A (hereinafter the "Property"); and <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-350 to allow construction of a new home <br /> on a property 16,612 square feet in area in the LR-1 C zoning district where a minimum lot area <br /> of 21,780 square feet is required; <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-1279 to allow construction of a new home <br /> on the property as close as 52 feet to the OHWL of Lake Minnetonka where a 75-foot setback is <br /> required for structures; <br /> WHEREAS, the Applicants have made application to the City of Orono for <br /> variances to Orono Municipal Zoning Code Sections 78-1288 and 78-1680 to permit <br /> construction of a new home and hardcover improvements within 75 feet of the OHWL of Lake <br /> Minnetonka where no hardcover is permitted; <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br /> conditional use permit pursuant to Orono Municipal Zoning Code Sections 78-966 and 78-1286 <br /> to permit grading and filling activities within the 75-foot setback from the OHWL of Lake <br /> Minnetonka in excess of 10 cubic yards in order to remove the existing home; construct the new <br /> home and improvements; and conduct finish grading on the site; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the Orono, Minnesota, City Code, a public hearing was held by the <br /> Orono Planning Commission on April 21, 2014 at which times all persons desiring to be heard <br /> concerning this application were given the opportunity to speak thereon. <br /> Page 1 of 5 <br />
