AzL.O.Ai0 CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />q <br />G~ NO. 7448 <br />kE S H OR <br />A RESOLUTION <br />APPROVING A VARIANCE FROM <br />MUNICIPAL ZONING CODE <br />SECTION 78-1279 <br />FILE NO. LA23-000066 <br />WHEREAS,on December 13,2023,Hendel Homes(hereinafter the"Applicant"),applied for a <br />variance from the City Code for the property addressed 2605 Mapleridge Lane and legally described as: <br />Lot 7 and that part of Lot 8,"Shore Hills", described as follows: Beginning at the point of <br />intersection of the dividing line between Lots 7 and 8 in said Shore Hills with the shore of Lake <br />Minnetonka;thence Southerly along said dividing line to the Northerly line of Mapleridge Lane <br />in said Plat;thence Northeasterly deflecting to the left 150 degrees 25 minutes from last described <br />course a distance of 109.8 feet;thence Northerly deflecting to the left 29 degrees 00 minutes from <br />the last described course to the shore of Lake Minnetonka;thence Northwesterly along said shore <br />line to the point of beginning. (hereinafter the"Property"); <br />WHEREAS,the Applicant has applied to the City of Orono for an average lakeshore setback <br />variance setback from City Code Section 78-1279 in order to construct an addition and remodel an <br />existing home; and <br />WHEREAS,on January 16,2024,after published and mailed notice in accordance with Minnesota <br />Statutes and the City Code,the Planning Commission held a public hearing, at which time all persons <br />desiring to be heard concerning this application were given the opportunity to speak thereon; and <br />WHEREAS,on January 16,2024,the Planning Commission voted 4 to 0 in favor of a motion to <br />recommend approval of the variance as applied; and <br />WHEREAS,on February 12,2024 the City Council reviewed the application and the <br />recommendations of the Planning Commission and City staff; and <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota <br />hereby approves the requested variance as described above based on one or more of the following findings <br />of fact concerning the Property: <br />FINDINGS OF FACT: <br />1.
