797 Ferndale Rd N <br /> <br />Description of Request: <br /> <br /> <br />1. Request for an average lake shore setback variance to contrast a new home on a vacant lot. <br /> <br />We are seeking to request a variance for the average lake shore setback in connection with the <br />proposed construction of a new residential home on the vacant lot located at 797 Ferndale N. <br /> <br />The subject property, a 3-acre wooded lot with lakefront access to Lake Lydiard, was originally <br />plotted in the early 1990s for the development of a single-family residential home within the <br />established neighborhood. <br /> <br />The lot, which has remained vacant since its initial plotting, is currently owned by past adjoining <br />property owner, and is now intending to sell the property for the new owners to construct a <br />single-family home. The development plan proposed adheres to all setback and zoning <br />requirements stipulated by the city of Orono, except for the Average Lakeshore Setback. <br /> <br />The unique nature of the neighborhood's plot layout allocated a 5’ access of land to the property <br />of 793 Ferndale N, situated directly behind (east) of the proposed construction site. <br />Consequently, the current average lake shore setback does not extend across the property of 797 <br />Ferndale Rd. N, as both the side yard and rear yard are bordered by the property of 793 <br />Ferndale Rd N. <br /> <br />In our meticulous planning process, we have ensured compliance with the 150’ setback <br />requirement from the lakeshore, as well as all other relevant setback criteria. Despite meeting <br />these conditions, the construction of any structure on this property necessitates a variance due <br />to its unique historical development. The property was originally plotted and approved in the <br />early 1990s for the construction of a single-family home, a plan that was never executed upon <br />until now. <br /> <br />We appreciate your time and consideration in reviewing this request.
