All failing systems shall connect to the sewer immediately <br />upon its availability. <br />2. All systems determined to be non-conforming (including <br />those too near the watertable and/or less than 75' from the <br />creek or lake and/or less than 50' from a well) shall connect <br />to the sewer within 16 months of its availability. <br />3. Any "code" or "conforming" functional system constructed <br />prior to January 1, 1978 (the approximate effective date of <br />contemporary septic codes) shall connect to the sewer within <br />16 months of its availability. Such systems will have had a <br />useful service life of 15 years or more. <br />4. Any "code" or "conforming" system constructed between <br />January 1, 1978 and January 1, 1988 shall connect within 36 <br />months of sewer availability or by January 1, 1996, thus <br />ensuring that such systems have had a useful service life of <br />between 8 and 17 years. <br />5. Any "code" or "conforming" system constructed after <br />January 1, 1988 shall connect within 60 months of the date of <br />availability, or by January 1, 1998, thus allowing a minimum <br />of 6 years and up to as many as 10 years of useful service <br />life for those systems. <br />6. Regardless of the above allowances, the sewer must be <br />connected upcn any sale of a property served with sewer. <br />7. All properties, regardless of connection status, start <br />paying the quarterly sewer charge at the end of the 16 month <br />standard connection period. <br />To maki some sense out of the various deadMne dates, staff would <br />draft a resolution listing deadline dates for individual properties, <br />for Council adoption. However, in order to create such a list, the <br />system conformities need to be verified. This means that soil borings <br />and interpretation must occur on every property to determine whether <br />the existing system meets the vertical seasonal watertable separation. <br />While staff has the expertise to do such borings and interpretation, <br />any homeowner likely find a consultant who would dispute staff's <br />findings leading to conflicts. (We are wrestling with this issue in <br />all of the shoreland areas, not just Stubbs Ray, and are currently <br />assembling information from other jurisdictions ?s to how they are <br />approaching this issue). <br />The above sewer connection policy proposal is offered for discussion <br />purposes only at this time. Given my druthers, I would prefer to make <br />it much more simple by merely requiring Immediate connection for <br />failing systems and a one or two year extension of the 16 month period <br />for all other connections. However, such a proposal would likely not <br />be viewed as a compromise by the appellants.
