i;> <br />:' /■. • <br />w <br />III CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. __ ______ <br />CONCLUSIONSr ORDER AND CONDITIONS <br />Based upon one or more of the above findingsr the Orono City- <br />Council hereby grants a variance to Municipal Zoning Code Section <br />10.22, Subdivision 2 to permit the construction of a 7'xl8* second <br />story deck to the street side of the existing residence subject to the <br />following conditions: <br />y '.i.■ <br />1. <br />2. <br />* 3. <br />4. <br />5. <br />Applicant shall maintain hardcover within the defined <br />setback areas as follows: <br />0-75' setback area = 7,600 s.f. <br />existing = 1,022 s.f. or 13.45* <br />75-250’ setback area = 18,110 s.f. <br />existing = 6,990 s.f. or 38.6% <br />Applicant is further advised that any proposed improvements <br />to this property that results in increases in hardcover that <br />applicant will be expected to remove existing hardcover <br />either equal to or greater than hardcover resulting from <br />proposed improvements. <br />Applicant shall grant appropria-ue sanitary sewer utility and <br />access easements over existing municipal sewer lines on the <br />property. <br />Applicant shall obtain a building permit for the <br />construction of the second story deck and repair of existing <br />patio. <br />Authorities granted by this variance run with the property <br />not with the applicant, but are permissive only and must be <br />exercised by application for a building permit within one <br />year of the date of Council approval, or this variance will <br />expire on that date (May 11, 1993). <br />Violation of or non-compliance with any of the terms and <br />conditions of this variance shall constitute a violation of <br />the 2oning code, shall automatically terminate any authority <br />granted herein, and shall be punishable as a misdemeanor. <br />Page 3 of 5 <br />•ibiH
