RESOLUTION NO'. 669 <br />RESOLUTION SETTING FORTH REQUIREMENTS <br />TO BE'FULFILLED BY SUPER VALU IN ORDER <br />TO OBTAIN A REZONING PURSUANT TO THE <br />PROPOSED ORDINANCE ATTACHED HERETO <br />WHEREAS, Super Valu has applied for rezoning of certain <br />property in Navarre in the City of Orono, legally described in <br />Exhibit A attached hereto, and <br />WHEREAS, the City Council and Planning Commission agree <br />to conditionally rezone said property from LR -1B to B-3 as long <br />as certain requirements are met by Super Valu, <br />NOW, THEREFORE, BE IT RESOLVED: <br />1. The City Council of Orono shall adopt the ordinance <br />attached hereto as Exhibit A as soon as Super Valu grants to the <br />City of Orono in a form acceptable to City staff a perpetual open <br />space -conservation easement and municipal utilities easement over <br />the south 100 feet of the property now owned by Super Valu at the <br />junction of County Road No. 15 and No. 19 in Orono and which is <br />• now zoned as LR -1B and shall remain as LR -1B after the rezoning' <br />Super Valu shall provide the necessary legal description for City <br />staff. <br />2. Super Valu convenants and agrees to construct all of <br />Supermarket Phase 1 with a ground floor area of at least 16,000 <br />square feet within two years of the adoption of this resolution. <br />Super Valu agrees that the City may rezone the property legally <br />described in Exhibit A to LR-lB without being liable for any <br />claim for damages of any nature if Super Valu fails to meet the <br />two-year construction deadline as set forth herein. <br />The foregoing resolution was.adopted by the City Council <br />of the City of Orono by vote of four ayes and zero nays on March <br />8, 1976. <br />C �L <br />Robert L.
