The <br />application does not contain such illegal structures. All such <br />violations are subject to prosecution under Sections 5.42 and 10.41 of <br />the Orono Municipal Code. <br />Marina is not authorized for FUEL SALES (subject to compliance with <br />the State Fire Code). <br />V. Required number of OFF-STREET PARKING SPACES 68 <br />SPECIAL CONDITIONS required for compliance with the ordinances of the <br />City and/or the LMCD. The issuance of this license is subject to full <br />compliance with these conditions. Failure to comply with these <br />conditions is cause for license revocation and/or prosecution by the <br />City. <br />1. The following variances were granted via Resolution No. 2683 on <br />May 22, 1989: <br />A.0-75' hardcover of "25,609 s.f. or 15.48%" (current <br />corrected hardcover = 24,421 s.f. or 19.9% of recalculated <br />0-75' area of 123,000 s.f.) <br />NOTE: 75-250' hardcover = 5970 s.f. or 29.9% of 20,000 s.f. <br />75-250' zone (See Exhibit D attached). <br />B.Conditional Use Permit/Variance for land alterations in 0- <br />75' lakeshore protected area. <br />Nothing in this license shall confer upon any person for the benefit <br />of any property any vested right to use Lake Minnetonka or the <br />premises in a manner permitted by this resolution, but the use of Lake <br />Minnetonka and the premises shall remain subject to such regulations <br />and ordinances as the City and other competent regulatory authorities <br />shall deem necessary from time to time in the public interest. <br />Issuance of this license is not intended as a confirmation of <br />licensee's conformity with all ordinances regulating the site <br />conditions and operation of the commercial use.
