4. <br />5. <br />c) <br />There is adequate area on the 7 plus acre dry buildable <br />site to provide additional parkinq needs for guest <br />apartment use. <br />The septic design for the current residence und-^r <br />construction will have an adequate septic treatment <br />facility for the five bedroom home. <br />The City Council finds that granting a conditional use <br />permit to the applicants for tha construe^ on of a <br />guest/mother-in-law apartment within a new residence would <br />not be detrimental to the health, safety or general welfare <br />of the public, would not adversely affe'^t light, air nor <br />pose a fire hazard cr other danger to neighboring <br />properties, nor will it depreciate surrounding oroperty <br />values and that the proposed level of use of the roperty <br />will be in keeping with the intent and objectives of the <br />Zoning Code and Comprehensive Plan of the City. <br />The City Council has considered this application including <br />the findings and recommendations of the Plann;:. t Jommission, <br />reports by staff and comments of the appli 'ants and the <br />affect of the proposed use on the health, ■a'^ety, and <br />welfare of the communitv. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City <br />Council hereby grants a Conditional Use Permit per Municipal Zon'ng <br />Code Section 10.27, Subdivisions 3 (A) to permit a guest apartment use <br />within the residence located at 4180 Bayside Road, stJbject to the <br />following condi*-iohs: <br />1. <br />2. <br />3. <br />The proposed guest/mother-in-law apartment shall never be <br />used for rental purposes. <br />Violation of or non-compliance with any of the terms and <br />conditions of this resolution shall constitute a violation <br />of the Zoning Code, snail automatically terminate any <br />authority granted herein, and sliall be punishable as a <br />misdemeanor. <br />The undersigned owners have read, understood and hereby <br />agree to the terms of this resolution and on behalf of <br />themselves, their heirs, successors and assign?; hereby <br />agree to the recording of this resolu ion in the chain of <br />title of the property. <br />Page 2 of
