V`OAtp CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> NO. 7452 <br /> kESHO� <br /> A RESOLUTION <br /> APPROVING VARIANCES FROM <br /> MUNICIPAL ZONING CODE <br /> SECTION 78-1279 <br /> FILE NO. LA23-000062 <br /> WHEREAS,on December 13,2023,Peter Eskuche(hereinafter the"Applicant"),applied for <br /> variances from the City Code for the property addressed 4423 North Shore Drive and legally described as: <br /> That part of Government Lot 3, Section 7,Township 117,North Range 23,West of the 5th <br /> Principal Meridian described as follows: Commencing at an iron post on the shore of Lake <br /> Minnetonka 26 feet Westerly of the intersection of the East line of said Lot 3 with the shore of <br /> Lake Minnetonka;thence in a straight line Northeasterly to a point in the West line of Lot 1, <br /> Block 18, Saga Hill Revised,Hennepin Co.,Minn., which is 104.2 feet South of the Northwest <br /> corner of said Lot 1;thence North along the East line of said Lot 3, Section 7,to the right of way <br /> of canal deeded to Saga Hill Association;thence Southwesterly along the Easterly line of said <br /> right of way 438 feet to said Lake Minnetonka to a point which is 350 feet more or less Westerly <br /> of the point of beginning;thence Easterly along the shore of said Lake Minnetonka to the point of <br /> beginning,according to the United States Government Survey thereof,Hennepin County, <br /> Minnesota. <br /> Together with an easement for right-of-way for driveway easement purposes over a strip of land <br /> in Lots 1 and 2, Block 18, Saga Hill Revised,Hennepin'County,Minn.,and in that portion of the <br /> tract of land lying between the North line of said Lots 1 and 2 and the center line of County Road <br /> No. 135 (now known as County Road No. 19 said strip of land being 12 feet in width and being <br /> six(6)feet on each side of the following described center line,to-wit: Beginning at a point in the <br /> West line of Lot 1 in said Block distant 91.6 feet South of the Northwest corner of said Lot 1, <br /> thence North 28 degrees 15 minutes East,making a Northeast angle of 28 degrees 15 minutes <br /> with the West line of said Lot 1,a distance of 38.8 feet;thence North 38 degrees 46 minutes East, <br /> 73.83 feet,more or less,to a point in the North line of said Lot 1, said point being 64.4 feet East <br /> of the Northwest corner of said Lot;thence continuing North 38 degrees 46 minutes East 70.1 <br /> feet,more or less,to a point in the center line of aforesaid County Road No. 19 and there <br /> terminating. The first above described course of said center line description shall be extended <br /> South 29 degrees 16 minutes West from the point of beginning a sufficient distance so that the <br /> side lines of said 12 foot strip will intersect the West line of said Lot 1 in Block 18. (hereinafter <br /> the"Property"); <br /> WHEREAS,the Applicant has applied to the City of Orono for an average lakeshore setback <br /> variance setback from City Code Section 78-1279 in order to construct a new home; and <br />- 1 <br />
