Refer to <br />the facts noted above. The 22* x 22' addition to the existing <br />that serves the residence structure was constructed <br />without the benefit of a permit review. As structure is open- <br />ended and refered to as lean-to by applicant, Mr. Dickey assumed <br />that a building permit was not necessary for this type of <br />structure. If the property was not legally combined, a setback <br />variance would have been required. Review Exhibit J. Note <br />dtructure intersects west lot l.ne of Tract A, RLS 10^9. with <br />the legal combination the setback variance is no longer required <br />but a variance to the total allowed area for accessory structures <br />is required. <br />The increase in height referenced in Mrs. Dickey's letter <br />occured during the time of the Golden View Drive construction and <br />soon followed by the residential construction. The Dickey's have <br />provided photos of the fence as it existed on the property in <br />earlier years and will be presented for Planning Commission's <br />review. Mrs. Dickey's addendum notes the history of the fencing, <br />the need for the alteration for an increase in height and the <br />hardships. For members who will ask the customary question, "Why <br />is the City dealing with the issue of the fence height at this <br />time?", staff would refer you to the earlier letters sent to the <br />applicant. Exhibit L, and also that this matter was first noted <br />bo the staff by at least two members of the Commission. <br />If the variance for the addition to the detached garage is <br />approved, staff would eck that you condition approval on <br />applicants obtaining a penalty building permit for the <br />unauthorised construction. At this time applicant may consider <br />adding doors to the 3-sided st-iucture. <br />Mon-Reatal/Guest Bouse Unit <br />Applicant was asked to filer a conditional use permit for the <br />second residential unit when the legal combination was applied <br />for on February 24th. The structure is older and was probably <br />part of the former farm homestead. The structure has been <br />maintained by the Dickey's. It is staff's understanding that <br />their daughter resides in the residence. Applicants understand <br />completely that the structure can never be rented in its current <br />status. If the applicants plan to either rent or sell this <br />structure in the future, there is adequate area to support the 2- <br />acre required area standard. Your approval of this conditional <br />use permit must be conditioned on the structure never being <br />off^ red for rent.
