Date: March 11, 2024 Item: 15 <br />Presenter: Natalie Nye, Planner <br />Section: Community Development Report <br /> <br />Title: LA23-000062, Peter Eskuche, 4423 North Shore Drive, Variances, <br />Resolution 7452 <br /> <br /> <br />1.Purpose: <br />This application is regarding variances from average lakeshore setback and bluff setbacks in order <br />to construct a new home. <br />2.MN§15.99 Application Deadline: <br />The application was received December13, 2023 and considered to be complete on December 26, <br />2023. Staff has administratively extended the deadline an additional 60 days per State statute and <br />therefore the 120-Day deadline will expire on April 24, 2024. <br />3.Background: <br />The applicant is proposing to construct a new home requiring variances from average lakeshore <br />setback and bluff setback requirements. The new home will be constructed in a similar location to <br />that of the existing home. The proposed home requires bluff setback variances in order to construct <br />a driveway, retaining walls, and grading within the bluff setback and bluff impact zone. The bluff <br />setback is 30 feet from the top of bluff and the bluff impact zone is 20 feet from the top of bluff. <br />The home also requested an average lakeshore setback variance for the new footprint. <br /> <br />The City Council tabled this item at the February 12, 2024 City Council meeting in order to visit <br />the site. Site visits were completed by some councilmembers the week of February 20th. <br /> <br />City Council reviewed the application on February 26, 2024 and directed the applicant to amend <br />the plans to modify the grading proposed to the west of the home associated with the basement <br />walkout and keep the existing retaining wall located at the top of the bluff. The applicant has <br />provided amended plans (Exhibit B & C). A brief summary of the changes made are listed below: <br />The existing retaining wall is no longer proposed to be removed - the retaining wall can now <br />be seen on the proposed plans. 10 feet of the retaining wall will include modifications with <br />one row of boulders remaining in place per Council direction. <br />Slight grading modifications have been made. There is still proposed grading within the <br />bluff setback and bluff impact zone to the west of the proposed home associated with the <br />walk out basement that is not conforming to the current city code. <br />Retaining wall placement directly west of the home to support the walkout basement remain <br />unchanged. <br />A new patio has been added (in a conforming location) just outside of the bluff setback. <br />The walkway/lake access changes within the bluff have been removed from the plan. <br />The garage has increased in size by 78 square feet. The expansion is within setbacks and is <br />conforming. <br />4.Planning Commission Vote and Comment: <br />On January 16, 2024, the Planning Commission held a public hearing.
