0 RESOLUTION #_646 <br />A RESOLUTION ALLOWING MR. RED DANIELS <br />THIRTY DAYS LEAVE WITH PAY AND OTHER <br />ACCRUED BENEFITS FOR A DISABILITY DISCHARGE <br />WITH FINAL TERMINATION ON DECEMBER 7, 1975 - 4:30 P.M. <br />WHEREAS, the City of Orono has the power to appoint and <br />discharge an employee with a hearing pursuant to Minnesota Statutes <br />412.111, and <br />WHEREAS, there are no statutory provisions requiring that <br />the City follow certain procedures in the discharging of an employee, <br />and <br />WHEREAS, there is no civil service commission in the City <br />of Orono, and <br />THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF ORONO: <br />1. Red Daniels per his admission is not a veteran under the <br />Veterans' Preference Act and does acknowledge that there are no other <br />requirements of the City to grant him a hearing or to take other <br />• administrative steps before termination of employment. <br />2. There has been an extensive investigation by the Clerk/ <br />Administrator and Chief of Police concerning Mr. Daniels' ability to <br />physically perform his duties as a police officer. <br />3. That investigation has resulted in a recommendation by <br />the Clerk/Administrator and Chief of Police that Mr. Daniels be <br />discharged because of the direct result of an injury, sickness and <br />disability incurred in and arising out of an act of duty while he was <br />performing his services as a police officer. <br />4. That as a result of the injury and sickness incurred <br />and arising out of an act of duty, that he can no longer physically <br />perform his duties as a police officer in the field. <br />5. That Mr. Daniels be allowed 30 days and other paid accrued <br />benefits beginning November 7, 1975, 4:30 P.M., with final employment <br />termination December 7, 1975, 4:30 P.M. <br />Adopted by the City Council of the City of Orono, Minnesota at a <br />regular meeting held November 10, 1975. <br />4�4_ Ad 4(4#C�4,vtle <br />W-aaTter B.
