Enclosed with the <br />ordinance is a completed copy of the Shoreland ordinance Review <br />Checklist to assist you in reviewing our ordinance for compliance <br />with statutes and Minnesota rules. <br />We understand that adoption of the ordinance absent preliminary DNR <br />jp^view and approval might be construed as putting the cart before <br />the horse. However, after what we feel is a thorough review by our <br />I^ke Use Coaoslttee comprised of 3 Council members, 2 Planning <br />Comsieeioners end our LMCD representative, the Planning Commission <br />and Council feel that the ordinance as drafted and adopted <br />substantially meets the requirements of the Department of Natural <br />Hesources while maintaining the integrity and principles of <br />shoreland management which have long been a part of our current <br />ordinance structure. <br />Furtherr in August 1991 the City Counci 1 adopted a moratorium on <br />subdivisions within the defined shoreland areas in order that no <br />nsw subdivisions be approved under what would shortly become an <br />outmoded set of regulations. Council felt that such a moratorium <br />would protect both the developer and the City from having to change <br />the rules in mid-stream. The Council also recognized that while <br />Orono is confident that the general DNR requirements are <br />substantially met with the adopted ordinance, DNR review could <br />extsnd over an additional period of months which would penalize <br />Orono developers who wish to proceed with their projects. <br />Ths City Council is preparing to lift the subdivision moratorium im <br />March 1992. We respectfully request that the DNR review the <br />adopted ordinance as expeditiously as possible, and if revisions <br />are necessary to comply with minimum DNR standards, we will work <br />with you to resolve these issues, and amend our code as necessary. <br />Flease feel free to contact Assistant Planning and Zoning <br />Administrator Mike Gaffron, City Administrator Ron Moorse, or me if <br />you have any questions. <br />Sincerely, <br />l^rabara A.
