He noted there is a difference of opinion about whether <br />this deck was ever previously approved. He noted that with any <br />variance application, an updated survey would be required, but the <br />applicant has indicated that he does not wish to supply the City <br />with an updated survey because of the cos^. <br />Mabusth stated that when McCurdy filed the after-the-fact variance <br />application, he appealed the request for an updated survey. At <br />that time, staff noted discrepancies with the original survey, <br />noting excesses of hardcover within the 0-75' area and changes in <br />the driveway. Mabusth noted that the applicant has indicated he <br />will allow the partially built deck to remain on the property <br />without approval and hold the City liable for any accidents the <br />partial deck may cause. <br />It was moved by Mayor Peterson, seconded by Goetten, to deny Dale <br />McCurdy’s request for special acception to the requirement of an <br />updated survey be provided, and that he has 60 days to submit an <br />updated survey, and If that deadline is not met, directs the City <br />to proceed with whatever penalties are appropriate. Ayes 4, na>s <br />0. <br />Jabbour asked If a survey was required of all applicants regarding <br />issues such as this. <br />Mabusth Indicated In the affirmative, and stated the staff has <br />acted consistently with this application as with other similar <br />appiicat ions. <br />(#7) #1704 C. ARNOLD CARLSON/DARLOW MADGE, <br />855/875 FOREST ARMS LANE - <br />CONDITIONAL USE PERMIT/VARIANCE - <br />RESOLUTION #3071 <br />Mr. & Mrs. Darlow Madge and C. Arnold Carlson were present. <br />Moorse explained that applicants are requesting approval of <br />alterations to a drainage ditch, which have been completed, and for <br />realignment of a drainage area so t functions better. <br />Goetten stated that these properties handle the drainage for the <br />surrounding area. <br />Xk <br />i <br />-. t-ft
